Abstract

Leniency Program On Cartel Agreements in Realizing Consumer Welfare in Indonesia" which consists of two problem formulations, namely First, Characteristics of Leniency Programs Against Proving Cartels in the Perspective of Business Competition Law. Second, Urgency of Implementing Leniency Programs Against Case Analysis of Cooking Oil Scarcity in Indonesia. This research is a normative legal research using several approaches, namely the legislative approach, conceptual approach, and case approach. The results of this study answer the problems, namely First Characteristics Leniency Program Regarding the proof of a cartel, a form of pardon is given to the accused who helped uncover a cartel case that is difficult for competition law enforcement to uncover, such as the alleged cartel in the cooking oil shortage that occurred in Indonesia. Then, the application ofLeniency Programon the analysis of the cooking oil scarcity case to overcome the public unrest over the scarcity of a product and price increases that disrupt consumer living needs so as to maintain a conducive economic climate and not give rise to other cooking oil cartel cases such as Decision Number 15/KPPU-I/2022 which punished 7 (seven) of 27 (twenty-seven) companies with a fine of IDR 71.28 billion. Therefore, consumers will prosper and business actors will find it difficult to make prohibited agreements in the world of business competition through the implementation of a leniency program in Indonesia
